1. BA22-43 Jonathan & Jama Hansonbrook, (2 Jessitar Road) – Area Variance – for construction of a detached two-story, two-car garage with an exterior stairway to second floor office space within the required front yard in an R-1 zoning district, per Article V, Section 250-15 of the Zoning Ordinance. The request is for a front yard setback variance of 14 ft. where 35 ft. is required; 26.2 ft. is existing; and 21 ft. is proposed.
2. BA22-44 Nicholas Sainz-Xatzis (8 Lost Pond Lane) – Interpretation or Area Variance – For the interpretation of Article XIII Section 250-72(A) of the Zoning Ordinance of the Town of North Salem; to reconsider the determination by the Building Inspector that dust-free arena footing falls under “dustproducing substance” or, in the alternative, an area variance per Article XIII, Section 250-72(A), to allow a footing material change from grass (approved by BA20-34) to dust-free arena footing within the side and rear yard setbacks in an R-4 zoning district. A side yard setback variance of 119 ft is requested where 150 ft. is required, 31 ft. is existing, and 31 ft. is proposed. A rear yard setback variance of 105 ft is requested where 150 ft. is required, 45 ft. is existing, and 45 ft. is proposed.
3. BA22-45 Nicholas Sainz-Xatzis (8 Lost Pond Lane) – Special Permit Amendment – to amend Special Permit BA19-29 (for the keeping of up to five (5) horses for personal use) subsequently amended by Special Permit BA20-34. The request is for a change in the surface material of the riding ring from grass (approved by BA20-34) to dust-free arena footing, per Article XIII Section 250-72.
4. BA22-46 Hammond Museum (owner)/ Homeland Towers, LLC and New York SMSA Limited Partnership d/b/a Verizon Wireless (lessee), (28 Deveau Road) – Area Variance – for construction of a 100 ft. monopole within a proposed wireless telecommunications facility. The proposed location of the monopoleis within the required side yard along the southern lot line in an R-4 zoning district, per Article XIII, Section 250-77.5(E)(4) of the Zoning Ordinance. The request is for a side yard setback variance of 54 ft. where 175 ft. is required and 121 ft. is proposed.
